A clear agreement for gathering well.

These Terms explain the promises everyone makes when using Orbit. They apply to organizers, account holders, and guests who join a private event.

1. Your agreement with Orbit

These Terms of Use form a binding agreement between you and Orbit, a product operated through Sark Media (“Orbit,” “we,” “us,” or “our”). By creating an account, checking the agreement box, joining an event, or otherwise using the service after being shown these Terms, you agree to them and acknowledge the Privacy Notice.

If you do not agree, do not create an account or join an event. If you use Orbit for an organization, you confirm that you have authority to accept these Terms for it.

2. Who may use Orbit

You must be at least 13 and able to understand this agreement. Anyone under the age required to consent to online services where they live must use Orbit only with a parent or legal guardian’s permission. Organizers must be at least 18.

Orbit is not directed to children under 13. Do not create an account for a child under 13 or ask a child under 13 to submit personal information directly to Orbit.

3. Accounts and private invitations

You are responsible for accurate account details, the security of your sign-in method, and activity performed through your account or guest session. Tell us promptly if you believe access has been compromised.

Invitation links are private access credentials, not public listings. Organizers choose recipients and are responsible for sharing links with the intended group. Guests must not publish, sell, scrape, or forward an invitation outside that group without the organizer’s permission.

4. Organizer responsibilities

Organizers control event details, invitations, guest modules, retention choices, and any linked external album. Organizers must have a lawful basis and all permissions needed to invite people, enter guest-specific information, post venue or accommodation details, and collect RSVPs, messages, photos, or videos.

Organizers must describe the event honestly, respect requests to remove guest information or content where required, and avoid using Orbit for emergency instructions, professional advice, ticketing, or any purpose where a delay could cause harm.

5. Your content and permission to operate the service

You keep ownership of event details, messages, photos, videos, and other content you submit (“Your Content”). You confirm that you own Your Content or have all permissions needed to upload it and allow the invited group to view it.

You grant Orbit a worldwide, non-exclusive, royalty-free licence to host, copy, process, compress, transcode, create thumbnails from, display, transmit, and delete Your Content only as reasonably needed to operate, secure, improve, and support the service. This licence ends when the content is deleted from our systems, subject to reasonable backup, fraud-prevention, and legal-retention periods.

Do not submit content that violates privacy, publicity, copyright, trademark, or other rights. If people are identifiable in sensitive or private moments, get their permission before sharing.

6. Media, storage, and external albums

Free limits, upload windows, retained quality, and expiration dates are shown in the product and may change prospectively. Orbit may compress media and discard temporary originals after processing. Keep your own original copies. Orbit is not a backup or archival service.

If an organizer links Google Photos, Apple Photos, or another external destination, that provider controls its album and terms. Orbit may store and open the link but does not control the provider, its permissions, availability, or deletion practices.

7. Generated event artwork and information

When requested, Orbit may generate or select event artwork from the title and a limited description. Generated artwork may be inaccurate, similar to other artwork, or unsuitable. The organizer must review it and may not use it to mislead or infringe another person’s rights.

Maps, venue suggestions, directions, weather, and intelligent event answers may come from third parties or automated systems. They are conveniences, not guarantees. Verify addresses, accessibility, travel, safety, weather, and time-sensitive information independently.

8. Acceptable use

You may not use Orbit to harass, threaten, exploit, deceive, impersonate, discriminate, stalk, distribute intimate content without consent, facilitate illegal activity, expose another person’s sensitive information, upload malware, evade limits, probe private events, scrape data, reverse engineer protected parts of the service, or interfere with security or availability.

We may investigate, restrict, remove, preserve, or disclose content or access when reasonably necessary to protect people, respond to a valid legal request, enforce these Terms, or keep Orbit secure. We are not obligated to monitor every event and do not endorse user content.

9. Plans, charges, and changes

Free limits are not a promise of permanent free capacity. If paid plans become available, price, billing period, included limits, taxes, renewal, cancellation, and refund terms will be shown before purchase. A waitlist or upgrade-interest button is not a purchase.

We may add, change, suspend, or retire features and limits. If a change materially affects an active paid commitment, we will provide the notice and remedy required by applicable law.

10. Beta service and availability

Orbit may be offered as a private beta. To the fullest extent permitted by law, the service is provided “as is” and “as available.” We do not promise that it will be uninterrupted, error-free, compatible with every device, or that content will never be lost. Loading, processing, maps, email, external providers, and internet connections may fail.

Nothing in these Terms excludes warranties, remedies, or rights that cannot legally be excluded.

11. Limitation of liability

To the fullest extent permitted by law, Orbit and its operators, suppliers, and personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, opportunities, goodwill, or data; or harm caused by user content, event conduct, private-link sharing, external providers, or reliance on generated information.

To the fullest extent permitted by law, our total liability for all claims arising from the service will not exceed the greater of the amount you paid Orbit in the 12 months before the claim and CAD $100. This limit does not apply where prohibited by law, including liability that cannot be limited for fraud, wilful misconduct, gross negligence, personal injury, or mandatory consumer rights.

12. Your responsibility for claims

To the extent permitted by law, you will indemnify Orbit against third-party claims, losses, and reasonable legal costs arising from Your Content, your event, your violation of another person’s rights, or your material breach of these Terms. This does not require you to cover harm caused solely by Orbit’s own unlawful conduct.

13. Suspension, deletion, and survival

You may stop using Orbit and request account deletion. We may suspend or terminate access for serious or repeated violations, security risk, non-payment, legal requirements, or discontinuation of the service. When practical, we will provide notice and a reasonable chance to export available content.

Sections that by their nature should survive—such as ownership, licences already required to complete deletion, limitations, indemnity, and dispute provisions—continue after access ends.

14. Law and disputes

Before filing a claim, contact support@letsorbit.app and give us 30 days to try to resolve it informally. These Terms are governed by the laws applicable where Orbit is operated, without overriding mandatory consumer protections or your right to bring a claim where applicable law requires.

15. Changes and contact

We may update these Terms. We will show a new version date and request renewed acceptance when a material change requires it. Continued use after the effective date of a non-material change means the updated Terms apply.
